Health Guarantee; Terms & Conditions

PUPPY HEALTH AT TIME OF PICKUP
Seller shall have the Puppy examined by a licensed veterinarian as near as feasible to the pickup and determined to be free of disease or injury. The Puppy will have first shots and any worming treatments if recommended by the veterinarian.

BUYER AGREES

1) To have the puppy examined within (72 hours) of purchase by a licensed veterinarian if disputing the puppy’s guarantee as listed in this contract (see below).

2) To provide all annual vet exams, to continue all required vaccine shots as recommended by their vet, and proper vet care. It is important the puppy has all required puppy shots and their yearly boosters. This dog shall be given adequate and proper shelter and housed securely. This dog shall NOT be restrained routinely by chaining to a stationary object (tree, post, etc.). Further, this dog shall NOT be used for any inhumane, immoral, or illegal purposes.

3) The puppy is not being purchased for resale and will never be sold to a pet shop, puppy mill, or agent of the same. Buyer understands that he/she will receive limited registration pedigree papers for the American Kennel Club (AKC). Notification will be given to the Seller/Breeder first if for any reason the Buyer no longer wants or is capable of keeping the dog.

4) Buyer agrees not to use puppy for breeding purposes or breed said dog.

5) If for any reason mediation should occur, mediation shall be held in Fergus Falls, Minnesota. Breeder will not be responsible for any costs associated with this process. The Buyer shall maintain contact with the Sellers/Breeders. No guarantees or warranties expressed or implied, are given by Sellers/Breeders, except those stated herein. Buyer warrants and agrees that he/she is the lawful owner of this dog and is alone responsible for entering into this contract with the Sellers/Breeders.

BREEDER AGREES

1) Breeder guarantees that a licensed Veterinarian has examined the above puppy and was found to be in good health. Puppy has received its first shots and wormed (as recommended by the veterinarian). Medical records will be furnished at the time of purchase. If within 72 hours of receiving the puppy and he/she is examined by a reputable veterinarian and the health of the puppy is found to be at risk due to a congenital defect (existing at birth), the owner shall notify the breeder and provide a written statement from a licensed vet describing puppy’s condition and shall return the puppy and papers to the breeder within three days of the examination and breeder will replace puppy or refund money provided puppy is in the same condition mentally and physically as when originally purchased. This does not include worms, fleas, mites, cocci, giardia, or any other parasites, as they are common in dogs and puppies. A monetary refund is only applicable if the puppy is returned to the Breeder within one week of the date of this contract, which is the date the puppy was picked up by the Buyer.

2) Breeder also guarantees that reasonable precautions have been taken to prevent this puppy from acquiring hereditary defects of the hips, eyes, and heart. However, due to unknown hereditary and environmental causes of such defects, no guarantee will be given against them. That, however, should be said puppy is diagnosed by board certified specialist as being affected by one of the above defects, the Breeders will at their discretion take the puppy back and/or refund the original cost or a portion of it at the Breeder’s discretion. We reserve the right to have a second opinion from our veterinarian. We also reserve the right to acquire DNA to determine the dog or puppy as one of our lineages.

3) Breeder is not responsible if the puppy contracts a communicable disease after leaving the breeder’s possession.

4) Breeder guarantees that for a period of one (1) year from the date of birth of the puppy, the puppy will not have or develop hereditary heart defects (this does not include benign heart murmurs puppies commonly have which disappear by roughly 6 months of age), hip or elbow dysplasia and/or cataracts. This guarantee is non-transferable. If Buyer’s Veterinarian determines the puppy to have any of said conditions as a result of a hereditary defect, the Buyer must have the condition confirmed by the OFA. Seller will provide a new puppy for Buyer, not a refund, provided Buyer delivers to Breeder a verified letter from Buyer’s Veterinarian confirming that the puppy has one or more such conditions. Additionally, all test results from OFA must also be submitted, at the Buyer’s expense. The Breeder furthermore reserves the right to have the puppy examined by a Veterinarian of their choice to confirm the diagnosis. If the Seller does not have a selection of puppies at the time of any such claim, the Buyer will be given the opportunity to select a puppy from the Breeder’s next litter. Any surgical or medical procedures will be done at the Breeder’s discretion

To be covered by this guarantee, the following conditions need to apply:

a) Puppy must be owned by the original owner named in this agreement.

b) In the case of the sudden demise of a puppy, the breeder must receive a written notice of the puppy’s death from the owner’s vet, along with a necropsy report indicating the cause of death.

Breeder does not guarantee the color, size, championship, or temperament of any puppy. We hope that you will enjoy your puppy for years to come. We have taken steps to ensure that your new puppy is healthy by feeding premium puppy food and we hope you will continue a quality diet for your pet(s).

LIMITATIONS OF THIS GUARANTEE

This guarantee is non-transferable. The puppy must be in good physical condition. No refund will be given if a female has been bred. A licensed veterinarian must do all laboratory verifications. The buyer/owner is responsible for all transportation costs to and from the breeder. The breeder is not responsible for any veterinarian expenses accumulated on returned or replaced dogs or puppies.

THE FOLLOWING POINTS WILL VOID ALL GUARANTEES

1) Allowing your dog to become an unhealthy weight at any time.

a. Underfed: Ribs are highly visible

b. Ideal Body Condition: Can feel and see the outline of ribs. The dog has a waist when viewed from above. Belly is tucked when viewed from the side.

c. Overfed: The dog has no waist when viewed from above. Belly is rounded when viewed from the side.

2) Evidence of neglect (ex: not taking the dog to the veterinarian as recommended) or abuse.

3) Previous related trauma (broken bones, related injuries, etc.)

4) Dog has been bred.

5) Feeding this dog anything other than a premium quality adult, one food for all stages of life (like Zignature, Taste of the Wild, Fromm, Purina Pro Plan), or a Large Breed type puppy food. It must say Large Breed on the bag if it is a puppy food.

6) Evidence of Strenuous Exercise – for example, No treadmill, no jogging, no extensive standing on the back of legs, or excessive tennis ball chasing and retrieving should be done – especially on slippery floors.

RIGHT OF RECOVERY/PLACEMENT

In the event the Buyer is unable to keep the dog or provide an appropriate home per this agreement, the dog with its title/registration will not be transferred to any person or organization other than the Breeder, whether by sale, gift, loan, or otherwise unless agreed to by the Breeder in wiring. The buyer agrees to notify the Breeder if any such contingency arises and will not abandon the dog to a shelter or sell or give the dog away.

 

LIMITED AKC REGISTRATION

Limited AKC Registration status as stated by AKC means that the dog is registered but no litters produced by the dog are eligible for registration. No offspring of a dog for which has been granted is eligible for registration. The buyer agrees that this puppy is not to be used for breeding or breeding purposes.

REGISTRATION
The Breeder certifies that the dog is eligible for Limited registration under the Regulations of the American Kennel Club as a purebred Golden Retriever and will provide the proper forms for such registration. Registration papers will be delivered with the Puppy.
